TERMS & CONDITIONS
By using our website and store/s, you are agreeing to the following terms and conditions (t&c's).
1: THE PARTIES. The trading name Re:Circle (recircle.nz, we, us, our) operates a business that allows the 'seller' and 'buyer' to facilitate a transaction for goods in-store.
2: THE SELLER. Re:Circle acts as the facilitator of the transaction between buyer and seller, both parties have no right of return for the transaction. 2.1: As a seller, you must register and create a 'My Re:Circle' profile on our website or in-store. You are obligated to provide your ID and any other information, on request.
2.2: As a seller, you must ensure that the information held in your 'My Re:Circle' profile is kept up-to-date whilst actively selling with us. This includes, but is not limited to, providing a valid New Zealand bank account number in order to receive a pending payout.
2.3: As a seller, you will pay for the stall rental and the commission shown through the booking process. 2.4: Stalls that are booked and paid for are non-refundable. Stalls can not be requested or reserved. The stall number will be allocated on the day that the seller's rental starts.
2.5: The quality of items sold are the sellers obligation. All items sold must be legal according to current New Zealand law. We do not accept the sale of tobacco, vaping products, drugs, pornography, offending material or stolen goods. 2.6: Re:Circle accepts no liability for theft and missing items and does not provide any insurance for items sold in-store. At no stage can a seller be reimbursed for items that are lost or damaged in the shop or while in transfer. Any claims for theft are to be managed by the seller with their insurance company as a claim under their home contents insurance policy. 2.7: In the event where stolen or illegal items are sold, we will contact the appropriate authorities with information about the items and the seller. 2.8: Prior to the stall rental period ending (i.e. 5pm on the final day of rental, at the latest), sellers must pack down all of their items and return tags to us for check-out. A pack down and/or storage fee may be charged for uncollected items. 2.9: Any uncollected items will become the property of Re:Circle after 28 days, and may be repurposed, resold, donate or dispose of at our discretion. 2.10: As a seller, your sales balance can be viewed on you ‘My Re:Circle’ profile. We will endeavor to ensure that this is kept up-to-date and as accurate as possible at any time, however, we don't accept liability for any delay or inaccuracy at any time. 2.11: We will make payment to sellers, less commission, to your nominated bank account twice a month. The first payment will be made on or around the 15th, and will cover sales since the 25th of the month prior to the 10th of the current month. The second payment will be made at the end of the month, to cover sales from the 11th through to the 24th. It may take 1-3 working days before a seller's bank has registered the transfer and that there may be a further delay if the payment date falls on a weekend or a public holiday. We do not offer cash settlement or payment to any other bank account that that provided in the seller's 'My Re:Circle' profile. 2.12: Sellers may use their sales balance to purchase items from other sellers (in the same store only). All sales between sellers must be done through the store.
3: THE BUYER. Re:Circle acts as the facilitator of the transaction between buyer and seller, both parties have no right of return for the transaction. 3.1: Payment by buyers must be made at the time of purchase. Payment can be made by cash, EFTPoS, credit card and any other methods stated at the store front. We do not offer any credit facility. 3.2: We do not accept any responsibility of the quality and description of the goods offered for sale by sellers. 3.3: The purchase by a buyer is on an ‘as is’ basis. This means there will be no refund or exchange offered once the sale is completed. From time to time, we may choose, at our discretion to take back a sold item. In this case the buyer will be refunded, the sale will be reversed in the seller's 'My Re:Circle' profile and the item returned to them. 4: GENERAL. 4.1: We expect all sellers and buyers to behave considerately and behave in a manner that is safe and respectful to others. We reserve the right to terminate a seller's rental, refuse entry or issue a trespass notice to anyone whose conduct compromises the security of items or the safety, well being, or experience of others - be that other sellers, buyers or our staff.
